SHORT-TERM RENTAL AGREEMENT FOR THE SEASCAPE CONDO

CONDO’S INFORMATION

PERSON RESERVING THE UNIT must be 25 y. o. or older to rent the property. We welcome guests under 25 if they are a married couple.

PROPERTY: The condo is only 516 sq ft total (1 bedroom,1 bathroom). It is comfortable for 2 adults with up to 2 young kids. If your group has 4 adults in the group, condo is manageable but can be a little bit tight.

VISITORS: Day time visitors are allowed for as long as the Owners are notified about them (including the number of those guests and the duration of their stay) and for as long as the total number of people staying in the condo does not exceed 4 people. Inviting extra guests for an overnight stay without notifying the Owners is a breach to the rental agreement and will result in immediate eviction without refund.

SMOKING: This condo is only for rent to NON-SMOKERS (inside smoking, outside, e-cigarettes).

PETS: NO PETS ARE ALLOWED AT THE RESORT. The only exception to this rule is service animals and the HOA requires proper documentation for such animals. The reservation cannot be fully confirmed until the HOA approves such documentation.

WHEELCHAIRS AND WALKERS: not suitable for our unit due to the small size of the condo.

CHILDREN: Condo is NOT CHILDPROOFED. By signing this agreement, the guests agree that they are always solely responsible for the actions of the children in their party at or about the property and that the Owners carry no responsibility or liability. Condo doesn't have any furniture for kids and bedroom doesn't have any place for pack and play.

CHECK-IN IS AFTER 4 PM AND CHECK-OUT IS BY 11 AM: The guests will be provided with a personal front door code, which works from 4 pm of the day of arrival till 11 am of the day of departure. If you want to come earlier, please contact us a day before your arrival.

If guests do not vacate the property on time without prior arrangements and the cleaning team will have to wait for their departure, the Guest will be charged a late check-out fee of $50, plus $25 for every 20 min of wait to compensate the cleaning team for their time.

HOUSEHOLD SUPPLIES: We provide an initial supply of paper towels, toilet paper, garbage bags, detergents, etc. The additional supply of these items, if extra is needed, shall be the responsibility of the guests.

Please, bring your own beach towels and favorite toiletries (such as shampoo and conditioner).

SEASCAPE RESORT INFORMATION

PARKING: All parking is by permit only and is guaranteed for one vehicle per unit. The parking permit will be issued by our resort guard upon Guests’ arrival. Parking without a permit is subject to towing at the car owner's expense. It is possible to park a second car at Seascape depending on the season (the availability is determined by the guard). The only time our HOA allows trailers on the property is during the Biker Rally.

SWIMMING POOL: Swimming pool is open from 9:00 am to 11:00 pm. All guests must always have pool bands in the pool area in a visible fashion. The pool bands will be issued by our security guard.

Our resort is a family friendly community and is very quiet during most of the year. However, during a spring break (March-early April) or summertime Galveston is a very busy tourist destination and there is a possibility of hearing some pool area noise inside the condo.

Do not take condo towels to the beach/pool because they can be bleached. Towels, bathing suits, etc. must not be draped from balconies (HOA rule). Sun lotions, baby oil, kid's markers/pencils, some make-up products, and anti-acne products can leave permanent stain(s) on sheets, towels, and furniture fabric. In these cases, an extra fee will be charged for their replacement.

RIGHT OF ENTRY: The Owners and management’s representatives have the right to enter the property to conduct necessary work arising from emergency needs such as water leaks, fire, etc. Once a month HOA conducts a mandatory extermination around the toilet and under the sink. Unfortunately, we do not know the schedule and cannot predict if it will take place on your dates. If it will happen during your stay (HOA will place a notice in the elevator a few days prior), the management reserves the right to enter the condo for this job, it takes only 2-3 min. Extermination spray is completely safe for adults and children.

GRILL: There are several grills available for the guests on “First come, first serve” basis. Guests need to bring their own charcoal, lighter fluid, and long matches.


HOUSE RULES

BICYCLES, FISHING POLES, WAGONS: are not allowed inside the condo or on the balcony. If you need to bring any of these items on this trip, they must be kept in your vehicle.

SEAFOOD: The guests should use their own cooler for seafood. Do not keep seafood in the refrigerator or the freezer since it can be difficult to get rid of the fish smell. Any evidence of seafood smell will result in at least $200 charge for a deep cleaning of appliances to remove the smell.

AMENITIES: TV cable and wireless Internet are provided as a convenience only and are not integral to the agreement. No refund will be provided if the elevator is out of order or for lack of cable or internet, or for power outage, as these services are provided by third-party vendors.

NO TOLERANCE POLICY: The Owners uphold a NO TOLERANCE POLICY for illegal drugs, under aged drinking, driving under the influence of drugs or alcohol, excessive alcohol consumption, inappropriate behavior/language or any violation of the laws set by state of Texas. Any evidence of violation of this policy or receiving any complaints from the resort's management about the improper behavior of the guests are grounds for eviction of all group and will result in the automatic forfeiture of the rental amount and damage deposit in its entirety.

HOUSEKEEPING: The cleaning happens only after the guests’ departure, there is no daily housekeeping services. If guests need a new set of clean towels or sheets, we can contact our cleaning team on the Guest’s expense, or guests can use the washing machine inside the condo or an HOA provided washer and dryer located on the floor (operates on quarters).

The guests are required to keep the condo in clean condition at all times, since they pay only for the basic cleaning.

In an effort to keep the cleaning fee to a minimum, we ask our guests to perform some actions prior to check-out to avoid extra cleaning fee. Before your departure, please:

  • Load all dirty dishes and start the dish washer.
  • Take the trash out (including unwanted items from the refrigerator).

The Owners shall bear no responsibility for forgotten item(s).


CANCELLATION

After the reservation is confirmed, we are completely committed to you as our Guest and will never double book. We will keep the Property reserved for you and decline all other inquiries, and for this reason the reservation is NOT refundable, and NOT re-schedulable.

THE GUEST’S AGREEMENT TO THE SHORT-TERM RENTAL AGREEMENT FOR THE SEASCAPE CONDO

As evidenced by the signature set forth below the Guest confirms that ALL GUESTS in the party agree that:

  • Only the number of guests mentioned during the reservation will stay in the condo. Inviting extra guests either as day-time visitors or for an overnight stay without notifying the Owners is not permitted. It is against the house rules and considered as a breach to the rental agreement and will result in the cancellation without refund.
  • All terms, conditions and rules of the rental agreement have been accepted.
  • If any damage is done to the property either the Guest or by any other person in the Guest's party during their stay the Guest will be responsible for the full cost of replacement/repair of the damage.
  • UNDER NO CIRCUMSTANCES AND UNDER NO LEGAL THEORY, TORT, CONTRACT, STRICT LIABILITY, OR OTHERWISE, SHALL THE RENTAL PROPERTY OWNERS OR RESORT MANAGEMENT BE LIABLE TO THE GUEST OR ANY OTHER PERSON IN THE GUEST'S PARTY FOR ANY ACCIDENTS, INJURIES OR ILLNESS THAT OCCUR WHILE ON THE PREMISES OR ITS FACILITIES.
